Police say drowsiness or distraction led to fatal bus crash

New York State Police say a fatal rollover bus crash that took place on July 18 was caused by a driver who was distracted or drowsy. After investigating the accident, police concluded that the bus driver was not impaired by drugs or alcohol or using a cell phone when he veered off the shoulder of 1-87 in North Hudson. Investigators also concluded that there were no roadway defects, mechanical problems or other hazards that could have contributed to the wreck.

The fatal accident took place while a 61-year-old man was driving a 2008 commercial bus from Quebec to New York City with 55 passengers on board. For an unknown reason, the bus driver lost control and drifted to the left. The bus then fell down an embankment and landed on the driver's side about 300 feet away from the roadway.

As a result of the crash, a young girl from Quebec was killed on impact, and all of the other passengers were sent to area hospitals to be evaluated and treated. Four of the injured passengers were reported to have serious injuries. The bus driver was issued two traffic tickets from North Hudson Town Court for having an incorrect U.S. DOT marking and moving from a lane unsafely.

The family of a child who has been killed in a similar bus accident may have a case for filing a wrongful death claim against the bus driver. If the bus driver had previously been involved in other accidents, the family may also be able to hold the commercial bus company accountable for negligently retaining the driver as an employee.
